How a presale works

Each project sets its own terms. Your contract and disclosure statement have the details.

  1. Deposit

    You sign a purchase contract at a price set now and pay a deposit, usually 10% to 20% in two to four stages. Each project sets its own schedule.

  2. Disclosure statement

    The developer must give you a disclosure statement under the Real Estate Development Marketing Act. It sets out the plan, the deposit terms, the estimated completion and the risks.

  3. Rescission

    You can cancel within 7 days after you sign or receive the disclosure statement, whichever is later. An assignment, bought from another buyer, does not carry this right.

  4. Construction

    Completion dates are estimates and can move. The contract sets a last date, called the sunset clause. After it, you can usually cancel and get your deposit back.

  5. Completion

    You pay the balance, 5% GST unless the price includes it, and property transfer tax. The newly built home exemption can remove transfer tax on a home up to $1,100,000, with partial relief up to $1,150,000, for a buyer who qualifies and lives in it.
