These Terms of Service (the "Terms") govern your access to and use of relta.ca and any related digital properties (the "Site"). The Site is operated by Ray Rasouli ("I," "me," or "my"), a licensed real estate professional in British Columbia licensed with Real Broker B.C. Ltd., operating under the brand Relta Real Estate. Relta Real Estate is a brand and technology platform. It is not a brokerage and does not provide real estate services. The Relta software and product, and all intellectual property in them, are owned by Awesome Technologies and used on the Site under licence. All real estate services referenced on this Site are provided by Ray Rasouli through Real Broker B.C. Ltd. By accessing or using the Site, by creating an account, or by submitting any form, you agree to be bound by these Terms and by my Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) and capable of forming a binding contract to use the Site or to submit any inquiry or pre-approval request through it. By using the Site you represent and warrant that you meet these requirements.
The Site provides real estate information, market commentary, neighbourhood content, calculators, and advisory tools focused primarily on the British Columbia market. All content is provided for general informational purposes and does not constitute legal, financial, tax, mortgage, accounting, appraisal, or investment advice, and is not a substitute for professional advice tailored to your circumstances. You agree to use the Site lawfully, to provide accurate information through any form, and not to submit information about another person without their authorization.
You agree not to: (a) scrape, crawl, harvest, index, cache, or systematically extract data, listings, images, or content from the Site, or use any automated system, bot, headless browser, or data-mining tool to access the Site, except for search engines indexing publicly accessible pages in accordance with my robots.txt; (b) reproduce, republish, redistribute, sell, license, sublicense, or create derivative works from the Site or its content without my prior written permission; (c) reverse engineer, decompile, or attempt to derive the source code or underlying ideas of the Site; (d) circumvent, disable, or interfere with security or access-control features, rate limits, CAPTCHAs, or anti-scraping measures; (e) use the Site to send spam, phishing, malware, or unlawful content; (f) impersonate any person or misrepresent your affiliation with any person; (g) interfere with the operation, integrity, or performance of the Site or with any other user's use of the Site; or (h) use the Site in any manner that violates applicable law, regulation, or professional rule. I may suspend or terminate your access if I reasonably believe you have violated this section.
Certain features (including the dashboard, saved listings, alerts, and other personalization features) require an account. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. You agree to provide accurate and current information when registering, to promptly update your information if it changes, and to notify me at ray@relta.ca of any suspected unauthorized use of your account. I may suspend, restrict, or terminate accounts at my reasonable discretion, including for inactivity, violation of these Terms, or risk of fraud or abuse. You may close your account at any time by emailing ray@relta.ca.
Inquiries, contact requests, and leads submitted through the Site or any part of the Relta platform are received by Ray Rasouli, who as the licensed real estate professional operating the Site holds the first right of refusal to respond to and serve every contact generated through it. Where you request an introduction or consent to one, your inquiry may be shared with an independent licensed professional as described in these Terms and in my Privacy Policy. Submitting an inquiry does not create an agency relationship with Ray Rasouli; an agency relationship arises only under a written service agreement.
Property listing information made available through the Site is provided in part by The Canadian Real Estate Association ("CREA") Data Distribution Facility ("DDF") and by other licensed listing data sources (collectively, "Listing Data"). Listing Data is made available under licence to Ray Rasouli in his capacity as a licensed real estate professional; neither Relta nor Awesome Technologies owns Listing Data, which remains the property of CREA, the real estate boards, the listing participants, and the other respective rights holders. Listing Data is provided for your personal, non-commercial use only, may not be used for any purpose other than to identify prospective properties you may be interested in purchasing or leasing, and may not be copied, scraped, reproduced, redistributed, retransmitted, or used to build or populate any database, application, or service. Listing Data is provided "as is" and may be inaccurate, delayed, or incomplete; you should independently verify any information that is material to your decision. Trademarks (including REALTOR®, REALTORS®, and the REALTOR® logo, MLS®, Multiple Listing Service®, and the associated logos) are owned by CREA or other respective owners and are used under licence. By accessing Listing Data through the Site you also agree to the additional terms set out on my Listing Data Terms page.
The Relta software and product, including the Site's software, code, features, functionality, design, layout, graphics, illustrations, and logos, and the "Relta" and "Relta Real Estate" names and brand assets, together with all copyright and other intellectual-property rights in them, are owned by Awesome Technologies and are protected by Canadian and international copyright, trademark, and other intellectual-property laws. Other original content created for the Site (including text, copy, and photographs) is owned by or licensed to Ray Rasouli. This ownership does not extend to data that does not belong to Relta or Awesome Technologies, including: (a) Listing Data and other MLS® data, which are licensed to Ray Rasouli in his capacity as a licensed real estate professional and remain the property of CREA, the real estate boards, and the other respective rights holders; and (b) content, data, and trademarks originating from REALTOR.ca or its associated software suites, services, and domains (including related United States domains), which remain the property of CREA and their respective owners. I grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Site for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved to their respective owners.
If you believe that content on the Site infringes your copyright, please send a written notice to ray@relta.ca that includes: (i) a description of the copyrighted work you claim has been infringed; (ii) the URL or other description sufficient to locate the allegedly infringing material; (iii) your contact information; (iv) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (v) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner; and (vi) your physical or electronic signature. I may remove or disable access to allegedly infringing material and terminate the accounts of repeat infringers.
If you submit feedback, ideas, suggestions, photographs, or other materials to me (other than personal information governed by my Privacy Policy), you grant Ray Rasouli a worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to use, reproduce, modify, adapt, publish, and distribute those submissions for any lawful business purpose. You represent that you have all rights necessary to grant this licence and that your submissions do not infringe any third-party right.
By providing your mobile phone number and checking the SMS consent box, you expressly consent to receive recurring informational and transactional text messages from Ray Rasouli, including messages sent using automated technology. Consent to receive text messages is not a condition of any purchase or service. Message and data rates may apply. Message frequency varies based on your inquiry. Reply STOP to opt out at any time. Certain pages on the Site feature independent licensed mortgage professionals and a "Get pre-approved" request form. By submitting a pre-approval request you agree that your contact information and the financial details you provide (including annual income range, monthly debt range, and the home price you are considering) will be shared with the featured mortgage broker for the purpose of discussing pre-approval options with you.
After submitting a pre-approval request, a licensed mortgage broker will contact you directly by phone and/or email using the contact information you provided. This contact is for the purpose of discussing your mortgage options and is not a commitment to lend. You are under no obligation to proceed with any broker or lender.
Ray Rasouli may receive a referral fee from a mortgage broker if you choose to work with that broker and a mortgage transaction closes. This compensation does not affect the rates, products, or advice you receive from the broker. You are free to work with any mortgage broker or lender of your choice. Additional written referral disclosure may be provided at the point of any introduction, in accordance with applicable law.
Mortgage professionals featured on the Site are independent, licensed mortgage brokers registered under the Mortgage Brokers Act (BC) and regulated by the BC Financial Services Authority ("BCFSA"). They are not employees or agents of Ray Rasouli or of Real Broker B.C. Ltd. Ray Rasouli is a licensed real estate professional in British Columbia operating under Real Broker B.C. Ltd., regulated by BCFSA and subject to the rules of the Real Estate Council of British Columbia and the Real Estate Services Act (BC). For more detail see my Disclosure page.
The Site may contain links to, or integrate with, third-party websites, products, or services that I do not control. I am not responsible for the content, accuracy, availability, terms, or privacy practices of those third parties. Your use of any third-party service is at your own risk and subject to that third party's terms and policies.
THE SITE AND ALL CONTENT, LISTING DATA, MARKET DATA, ESTIMATES, CALCULATORS, AND OTHER MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. I DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY LISTING DATA, MARKET STATISTICS, PROPERTY DESCRIPTIONS, MORTGAGE OR AFFORDABILITY ESTIMATES, OR THIRD-PARTY CONTENT. ANY ESTIMATE, CALCULATOR RESULT, OR PRE-APPROVAL OUTPUT IS INFORMATIONAL ONLY AND IS NOT A COMMITMENT, OFFER, OR GUARANTEE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RAY RASOULI, REAL BROKER B.C. LTD., OR ANY OF THEIR RESPECTIVE AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, ANY CONTENT OR LISTING DATA, ANY INTRODUCTION OR REFERRAL, OR ANY MORTGAGE OR REAL ESTATE TRANSACTION, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MY TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100). NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, OR DEATH OR PERSONAL INJURY CAUSED BY MY NEGLIGENCE.
You agree to defend, indemnify, and hold harmless Ray Rasouli, Real Broker B.C. Ltd., and their respective affiliates, officers, employees, contractors, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (d) any information you submit through the Site.
I may modify, suspend, or discontinue all or any part of the Site at any time, with or without notice. I may also update these Terms from time to time. When I make material changes I will update the effective date and version at the top of this page and, where appropriate, provide additional notice. Your continued use of the Site after the effective date of an update constitutes your acceptance of the updated Terms.
I may suspend or terminate your access to the Site, or to any account or feature, at any time and for any reason, including for violation of these Terms. Sections of these Terms that by their nature should survive termination (including intellectual-property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution) will continue to apply.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict-of-laws principles. Subject to the dispute-resolution section below, you and I submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for the resolution of any dispute. Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction.
Before commencing any formal proceeding, you agree to first contact me at ray@relta.ca with a written description of your claim and to attempt in good faith to resolve the dispute informally for at least thirty (30) days. To the maximum extent permitted by applicable law, any claim or dispute will be brought on an individual basis only and not as a class, collective, or representative action; this class-action waiver does not apply where it is prohibited by applicable law.
These Terms (together with my Privacy Policy, Cookies & Tracking Technologies page, Disclosure page, and Listing Data Terms) constitute the entire agreement between you and Ray Rasouli regarding the Site and supersede any prior agreements on that subject. If any provision is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified only to the minimum extent necessary to make it enforceable. My failure to enforce any right or provision is not a waiver. You may not assign or transfer these Terms or any rights under them without my prior written consent; I may assign these Terms at any time without notice. Headings are for convenience only and do not affect interpretation.
